Terms of Service
Effective Date: September 13, 2026
These Terms of Service (“Terms”) govern your access to and use of https://tasta.ca and the products and services offered by Truly Fresh Grocery Delivery Inc., operating as TASTA (“TASTA,” “we,” “us,” or “our”).
By accessing our website, creating an account, or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree to these Terms, please do not use our website or services.
1. ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your province or territory of residence to create an account or place an order, or you must use our services with the involvement and permission of a parent or legal guardian.
You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
Please notify us promptly at support@tasta.ca if you believe your account has been accessed or used without authorization.
We may suspend or restrict an account where we reasonably believe it has been used fraudulently, unlawfully, or in violation of these Terms.
Our collection, use, and disclosure of personal information are described in our Privacy Policy.
2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, prices, quantities, and other information displayed on our website are accurate and current.
Product packaging and appearance may differ from the images displayed online. Manufacturers may also change product formulations, ingredients, nutritional information, allergen statements, sizes, packaging, or other product details without advance notice to us.
Product images are provided for reference. Fresh produce and other naturally variable products may reasonably differ in size, shape, colour, ripeness, or appearance.
Where country-of-origin information is displayed, we make reasonable efforts to keep it accurate. Please contact us before placing your order if country of origin is material to your purchasing decision.
You should always review the physical product label before consuming or using a product, particularly if you have allergies, dietary restrictions, sensitivities, or other health concerns. Product information displayed on our website is not medical or dietary advice.
Nothing in this section limits your rights in relation to products that are damaged, spoiled, unsafe, incorrectly delivered, or materially different from their description.
3. PRODUCT AVAILABILITY AND SUBSTITUTIONS
Product availability may change after an order is placed. Placing an item in your cart does not reserve that item.
If an ordered item becomes unavailable, we may:
- remove the unavailable item and refund or release the applicable amount;
- contact you to offer a substitute; or
- provide a reasonable substitute where you have authorized substitutions during checkout.
We will not substitute an unavailable item without your authorization.
If an approved substitute costs less than the original item, you will be charged the lower price. Any higher-priced substitution will be handled according to the substitution preferences and price limits presented to you at checkout.
If no appropriate substitute is available, or you have declined substitutions, the unavailable item will be removed from your order and you will not be charged for it.
4. ORDERS AND ORDER ACCEPTANCE
Submitting an order constitutes an offer to purchase the products in your order.
An automated order confirmation confirms that we have received your order, but does not necessarily mean that we have accepted it. We accept your order when we begin preparing it or send you confirmation that it has been accepted.
We may reasonably decline or cancel all or part of an order due to:
- product unavailability;
- pricing, listing, or technical errors;
- delivery limitations;
- payment authorization issues;
- suspected fraud, abuse, or unauthorized activity;
- quantity restrictions; or
- other circumstances that prevent us from fulfilling the order.
If we cancel an item or order after payment has been collected, we will refund the applicable amount to the original payment method. You will not be charged for an item or order that we cancel.
After placing an order, you will receive an electronic confirmation containing information about your order. Please review it promptly and contact us if you notice an error.
5. PRICING, TAXES, AND PAYMENT
All prices are displayed in Canadian dollars unless otherwise stated.
Applicable taxes, delivery fees, and any other mandatory charges will be disclosed before you submit your order. Your available delivery options and fees may depend on your postal code, delivery address, order value, and selected delivery date or window.
Payment must be successfully authorized before an order can be processed.
When you place an order, your payment method may be authorized for the estimated order total. The final amount charged may be adjusted to reflect:
- unavailable or removed items;
- approved substitutions;
- products sold by weight;
- applicable refunds or credits;
- taxes; or
- other adjustments disclosed to you at checkout.
If a product is displayed at an incorrect price because of a typographical, technical, or listing error, we may cancel the affected product or order and issue any applicable refund. Where reasonably possible, we may contact you and offer the option to purchase the product at the correct price.
6. PRODUCTS SOLD BY WEIGHT
Certain products may be priced based on weight. For these products, the price displayed when you place your order is an estimate based on the expected weight.
The final price will be based on the actual weight of the product prepared for your order and may differ from the estimated price, subject to any limits or information disclosed at checkout.
Your final receipt will show the final amount charged for the product.
7. MINIMUM ORDER REQUIREMENT
A minimum merchandise subtotal of CA$15.00, excluding taxes, delivery fees, tips, and other charges, is required to place a delivery order unless otherwise stated at checkout.
Promotional discounts may affect whether an order meets the minimum order requirement, as explained in the applicable promotion terms or at checkout.
8. PROMOTIONS
Promotional codes, discounts, and other offers may be subject to specific:
- eligibility requirements;
- minimum purchase amounts;
- expiry dates;
- participating products or delivery areas;
- product exclusions; and
- account, customer, household, address, or usage limits.
Promotions cannot be combined unless expressly stated.
Unless otherwise stated, promotions have no cash value and cannot be exchanged for cash.
If an order receiving a promotion is cancelled, refunded, or adjusted, the promotional benefit may also be adjusted or removed. The value refunded will not exceed the amount actually paid for the affected product.
We may refuse or cancel a promotion where we reasonably determine that it has been used fraudulently, unlawfully, as a result of an obvious technical error, or contrary to its stated conditions. This does not affect promotions that have been legitimately redeemed in accordance with their terms.
9. DELIVERY
Delivery availability, minimum order requirements, delivery days, cutoff times, fees, and applicable delivery areas are described in our Shipping Policy and at checkout.
Delivery availability depends on the address and postal code entered by the customer. Entering a postal code or viewing an estimated delivery option does not guarantee delivery until the order has been accepted.
Delivery dates and times are estimates and are not guaranteed. Deliveries may be affected by traffic, weather, road conditions, order volume, building access, power outages, supply interruptions, public emergencies, or other circumstances outside our reasonable control.
You are responsible for providing accurate and complete:
- delivery address information;
- unit or suite numbers;
- buzzer codes and building access instructions;
- delivery instructions; and
- contact information.
You are also responsible for ensuring that the delivery location is safe and reasonably accessible.
Where permitted by your delivery instructions or our Shipping Policy, an order may be left at your door, concierge desk, lobby, reception area, or another reasonably safe location. We may use delivery notifications or photographs to confirm delivery.
You are responsible for retrieving and properly storing refrigerated, frozen, and other perishable products promptly after delivery. We are not responsible for deterioration caused by an unreasonable delay in retrieving or properly storing an order after delivery has been completed in accordance with your instructions and our Shipping Policy.
This section does not limit our responsibility for products that were missing, incorrectly delivered, damaged, spoiled, unsafe, or not delivered in accordance with your instructions at the time delivery was completed.
If we cannot complete delivery because the address or contact information is incorrect, access is unavailable, the location is unsafe, or no permitted delivery option is available, the order may be returned, cancelled, or subject to a reasonable redelivery fee as described in our Shipping Policy.
10. CANCELLATIONS, REFUNDS, AND QUALITY CONCERNS
Order cancellation deadlines, refunds, credits, redelivery options, and product-quality concerns are handled in accordance with our Refund & Quality Guarantee Policy and applicable law.
Due to the perishable nature of certain products, we generally do not accept returns based solely on a change of mind.
If a product is missing, incorrect, damaged, spoiled, unsafe, or materially different from its description, please contact us within the reporting period stated in our Refund & Quality Guarantee Policy and provide:
- your order number;
- a description of the issue; and
- photographs where reasonably available.
Depending on the circumstances, we may provide a refund, account credit, replacement, or redelivery.
Nothing in these Terms or our policies limits any right or remedy that cannot legally be excluded under applicable consumer-protection law.
11. FOOD SAFETY, ALLERGENS, AND RECALLS
Information about ingredients, nutrition, allergens, and dietary suitability may be provided by manufacturers, suppliers, or other third parties.
Although we make reasonable efforts to display accurate information, customers with allergies, intolerances, sensitivities, or specific dietary requirements should review the physical product label before consumption.
If you have a severe or life-threatening allergy, please contact us before ordering if you require additional product information. We cannot guarantee that products or facilities operated by manufacturers, suppliers, or third-party partners are free from cross-contact with allergens unless expressly stated.
We may contact customers regarding product recalls, safety notices, or other material issues affecting a purchased product. Where permitted by law, these safety-related or transactional communications may be sent regardless of your marketing communication preferences.
12. ACCEPTABLE USE
You may not:
- use our website or services for an unlawful or unauthorized purpose;
- submit fraudulent, false, or misleading orders or information;
- interfere with the operation or security of our website;
- attempt to gain unauthorized access to an account, system, or network;
- introduce viruses, malicious code, or other harmful technology;
- scrape, copy, or collect website content or personal information through unauthorized automated means;
- misuse promotions, credits, accounts, or payment methods; or
- infringe the rights of TASTA or any third party.
We may restrict or terminate access to our website or services where we reasonably believe these Terms have been violated.
13. INTELLECTUAL PROPERTY
The TASTA name, logo, branding, website design, text, graphics, photographs, icons, software, and other materials made available through our website and services are owned by TASTA, licensed to TASTA, or owned by their respective rights holders.
You may access and use our website for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, publish, or commercially exploit any website content without prior written permission from TASTA or the applicable rights holder.
Product names, logos, and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
14. THIRD-PARTY SERVICES AND LINKS
Our website may use or link to third-party services, including payment processors, mapping services, delivery tools, and other websites.
Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control.
This section does not limit our responsibilities in connection with an order placed directly through TASTA.
15. LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts, or modifies any warranty, condition, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified under applicable law.
To the maximum extent permitted by law, TASTA will not be responsible for indirect, incidental, special, exemplary, or consequential losses arising from your use of our website or services.
To the maximum extent permitted by law, TASTA’s aggregate liability arising from a particular order will not exceed the amount paid for that order.
These limitations do not apply to liability arising from fraud, wilful misconduct, gross negligence, personal injury, unsafe products, or any other liability that cannot legally be limited.
16. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delays or failures caused by events reasonably outside our control, including severe weather, road closures, power outages, labour disruptions, public emergencies, government actions, supply-chain interruptions, or failures affecting third-party infrastructure.
This section does not limit any refund or cancellation rights available under applicable law where an order cannot be fulfilled.
17. CHANGES TO OUR SERVICES AND THESE TERMS
We may modify, suspend, or discontinue all or part of our website or services where reasonably necessary.
We may also update these Terms periodically. Updated Terms will be posted on this page with a revised effective date. Where appropriate, material changes may also be communicated through our website or by email.
Changes will apply prospectively and will not alter the terms applicable to an order that we have already accepted, unless the change is required by law or expressly agreed with you.
18. ELECTRONIC COMMUNICATIONS
You agree that we may provide order confirmations, receipts, delivery notifications, account notices, policy updates, product-safety notices, and other service-related communications electronically.
Marketing emails and text messages will be sent in accordance with applicable law and your communication preferences. You may unsubscribe from marketing communications using the unsubscribe method included in the message.
Unsubscribing from marketing communications does not prevent us from sending communications necessary to process an order, provide customer service, protect your account, or communicate a product-safety issue.
19. GENERAL TERMS
These Terms, together with our Shipping Policy, Refund & Quality Guarantee Policy, Privacy Policy, and any additional terms presented in connection with a promotion or service, constitute the agreement between you and TASTA regarding your use of our website and services.
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
If there is a conflict between these Terms and a right provided under applicable consumer-protection law, the applicable consumer-protection law will prevail.
20. GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any rights you may have under applicable consumer-protection law, disputes arising from these Terms or our services will be subject to the jurisdiction of the courts of Ontario.
